US judge reinstates Democratic labor board member fired by Trump
A federal judge on Thursday said U.S. President Donald Trump's firing of a Democratic member of the National Labor Relations Board was illegal and ordered that she be reinstated to her post.
The decision by U.S. District Judge Beryl Howell in Washington, D.C., restores a quorum of three members at the labor board, which had been paralyzed and unable to decide cases involving private-sector employers after Trump removed Gwynne Wilcox in January.
Wilcox claimed that Trump violated a requirement in federal labor law that NLRB members only be removed for "neglect of duty or malfeasance in office." The Trump administration acknowledged violating the law, but said the protections from removal for board members were unconstitutional.
Howell in a 36-page decision sharply rejected those claims.
"An American President is not a king — not even an 'elected' one — and his power to remove federal officers and honest civil servants like [Wilcox] is not absolute, but may be constrained in appropriate circumstances, as are present here," wrote Howell, an appointee of Democratic President Barack Obama.
"The President’s interpretation of the scope of his constitutional power — or, more aptly, his aspiration — is flat wrong," she added.
White House spokeswoman Anna Kelly called Howell "a radical liberal judge" and said her "clearly partisan opinion" would not be the last say on the matter.
"The Trump Administration will pursue all legal remedies to vindicate the President’s power for removal," Kelly said in a statement.
Deepak Gupta, a lawyer for Wilcox, said that "this decisive victory firmly rejects an extreme presidential power grab."
He said the decision was a win not only for Wilcox, but also for the integrity of the NLRB and its mission to protect American workers.
The NLRB, which has five members when fully stocked, enforces laws protecting private-sector workers' rights to organize, join unions and advocate for better working conditions, and oversees union elections.

I am betting my entire income on my position. Of course the market can go lower and probably will. Know what the market has never done? Gone to zero.Simmsy wrote: Sun Mar 09, 2025 7:13 pmI said his retirement accounts will disappear with the stock market, if you don't think they can't go lower...they can. You think your SS check will always come? Challenge accepted! They're coming for it, just because you don't think they won't doesn't mean its hands off. It was barely a year ago that the GOP was balking at Biden for even suggesting that the GOP would go after SS...yet here we are.Darrell Green Fan wrote: Sun Mar 09, 2025 6:17 pmI hate Trump more than any man alive. I also rely on Social Security as I am retired. I don't and will never believe my social security check will disappear, the problem is if there is an issue nobody will be home to help me. Yes the market may dip, but to claim anyone's entire retirement account will "disappear" is just not logical.Simmsy wrote: Sun Mar 09, 2025 12:31 pmOk, I have two personal FAFO/Leopards stories that I got to witness personally. I was worried about posting too many details, but I doubt they would ever find their way here and put two and two together. So, here goes:
1. The first one is a friend who voted Trump three times, he doesn't believe a woman should ever be president. He's got the Trump flag, giant sign in the yard and has no idea what is actually going on in the world. I don't know where he gets his news from specifically, but he spouts out Fox News talking points.
Anywho, he has to deal with copper. Its the main ingredient for his business and Trump is officially messing with the price of copper. First of all, it comes from Mexico (his does at least) and he hasn't been able to get any copper as soon as he has been in the past. On top of that, the tariffs have also raised the price of copper by 75 cents a foot. When you have to buy thousands of feet of copper, thats several thousands dollars added to the price. Now, to make things even more fun, Trump going up and down with the tariffs, makes it impossible to be able to price new jobs. The copper has to be bought well before, especially now, when it takes longer to get. Its hard to price a job based off of what you may and may not have and at what price when it takes even longer to get to the destination.
He believes the tariffs are going to make things better, but he didn't want Trump to effect HIS business directly, doesn't care about anything else. Trump said it was going to get worse before it got better, I didn't bother to tell him things will not get better. He thought Trump calling Elizabeth Warren, "Pocahantas" was hilarious at the SOTU, by the way.
2. The second guy is my boss, we talked about Trump before the SOTU. I tried to tell him about Musk and stealing Social Security, etc, he doesn't care. He's stupid and doesn't know anything about policy and falls for all of the fake stories that Trump drops on him. At one point he even told me, very smugly that "Trump is president and there is nothing you can do about it". He said that "Musk sure does have them scrambling", so I told him his retirement accounts were going to disappear with the stock market as well. He tried to tell me the stock market was up, I told him to check his accounts...he admitted that he didn't.
The next week the SOTU speech came up, he liked that Trump called Warren "Pocahantas" (these people are so stupid), didn't know about transgenic mice and all the other lies. I once again told him that Musk was going to take his SS (he thinks he will get it in 4 years), he's going to take everything so he can blow up his rockets on the taxpayer dime. Several hours later, a SpaceX rocket blew up and I sent him the link, telling him that I'm never wrong.
Well, that must've hit a nerve, Friday he's calling his account wondering about his accounts. Randomly talking about "How does Pelosi have all this money on her salary, she's worth millions?" and calling Democrats crooks. Well, I was trying to eavesdrop and I caught two main things: His accounts made $30k over the last two years (under Biden) and right now they're down a few percentage points for the year (or projected). Anyways, whatever he was told, was not good. He said "Its probably because of whats going on, huh?", meaning Trump being a dumbass. Once he heard that, from someone who isn't a black guy or a liberal, it became fact. He became quiet and wanting to move the goalpost like all Trumpers do...he'll be moving his goalposts deep into the red.
Let them lose their shirts, I'm just here to laugh at this point.
In short I agree with your position with regard to Trump and Elon. But telling your boss that his retirement account will disappear only hurts your credibility IMO.
Same with SS. You think the GOP who still needs to get votes to continue, will allow SS payments to cease or be reduced? No that's not going to happen either, they are cutting overhead not benefits. Seniors are a huge voting block and no party who wishes to continue will alienate this large group. And stopping SS benefits will definitely do that.
